1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of MadCatChat ("Service"), operated by MadCatChat ("we," "us," or "our"). By accessing or using the Service in any manner, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2 Description of Service

MadCatChat is a free online platform that provides public chat rooms where users may communicate in real time. The Service includes free public rooms and premium rooms created and managed by registered room owners. MadCatChat acts solely as a platform provider — it does not create, control, endorse, or take responsibility for any user-generated content.

3 Eligibility

You must be at least 13 years of age to use MadCatChat. If you are under 18, you confirm that you have your parent or guardian's permission to use this Service. By using MadCatChat, you represent and warrant that you meet this age requirement.

We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided information, we will take steps to remove it promptly.

4 User Conduct & Prohibited Content

You are solely responsible for all content you post and all conduct while using the Service. You agree that you will not use MadCatChat to:

• Harass, threaten, or abuse any other user, including stalking, bullying, or sending repeated unwanted messages
• Post illegal content, including content that violates any applicable local, national, or international law
• Share sexual content involving minors (CSAM) — this is strictly prohibited and will be reported to law enforcement immediately
• Impersonate any person, company, or entity, or misrepresent your affiliation with any person or entity
• Spam any chat room with repetitive, unsolicited, or commercial messages
• Share malware, viruses, or any code designed to harm systems or users
• Post personally identifiable information (real names, addresses, phone numbers) of other users without consent ("doxxing")
• Engage in hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Attempt to circumvent any moderation, bans, or technical measures of the Service
• Use automated bots, scrapers, or scripts to access or interact with the Service

5 User-Generated Content

MadCatChat is an interactive computer service. All messages, usernames, and other content posted by users ("User Content") are the sole responsibility of the user who posts them. We do not create or endorse User Content.

By posting User Content, you grant MadCatChat a non-exclusive, royalty-free, worldwide license to display and transmit that content solely for the purpose of operating the Service. You retain ownership of your content.

We may (but are not obligated to) monitor, review, or remove User Content at our discretion that we consider to violate these Terms or to be objectionable. This is a right, not a guarantee, and should not be relied upon as a safety assurance.

6 Limitation of Liability & Section 230 Notice

To the maximum extent permitted by applicable law, MadCatChat and its operators shall not be liable for:

• Any User Content posted, transmitted, or otherwise made available through the Service
• Any conduct, whether online or offline, of any user of the Service
• Any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service
• Any loss of data, profits, goodwill, or other intangible losses
• Any unauthorized access to or alteration of your transmissions or data

In no event shall our total liability to you for all claims exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or $10 USD, whichever is greater.

7 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We make no representations about the accuracy, reliability, completeness, or timeliness of any User Content. Your use of the Service is entirely at your own risk.

8 Premium Subscriptions & Payments

MadCatChat offers optional paid premium room subscriptions processed via Stripe or PayPal. By subscribing, you agree to the following:

• Subscriptions are billed on a monthly recurring basis at the displayed price
• You may cancel your subscription at any time through your room owner panel; cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial billing periods
• We reserve the right to change subscription pricing with 30 days' notice to registered room owners
• Payment processing is handled by third-party processors (Stripe, PayPal) subject to their own terms
• Failure to pay may result in your premium room being downgraded to a free room

9 Termination

We reserve the right, at our sole discretion, to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

You may stop using the Service at any time. Sections 5, 6, 7, 10, and 12 of these Terms shall survive termination.

10 Indemnification

You agree to defend, indemnify, and hold harmless MadCatChat and its operators, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of a third party

11 DMCA & Copyright

If you believe that content on MadCatChat infringes your copyright, please send a DMCA takedown notice to Contact Form with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on our Service
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf

12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MadCatChat operates, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of that jurisdiction.

13 Changes to Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent update at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
